A conviction against a Windsor man found guilty of second-degree murder has been overturned by the Ontario Court of Appeal.
In May 2011, Richard Zoldi was found guilty by a jury of second degree murder in the death of Troy Hutchinson, a known drug dealer.
In August 2006, Hutchinson was shot in the stomach at close range at Ford Boulevard and Reginald St, during a supposed drug deal, which in reality, was a ruse stemming from a previous stabbing.
No one saw who shot Hutchinson who called out "murder" and fell to the ground.
A gun, glove and t-shirt were found close to the scene and the t-shirt contained Zoldi's DNA profile.
Zoldi appealed the conviction based on what he claimed was four errors in the judge's instruction to the jury before deliberations.
The Court of Appeal agreed and ordered a new trial on the charge of second-degree murder.
