The Windsor-Essex Catholic District School Board will try again.
It will seek a court injunction to prevent pickets from delaying teachers from getting to class.
The application is scheduled to be heard in court on Tuesday.
370 workers represented by Unifor Local 2458 have been off the job since October 17th which has caused delays for teachers getting to class, especially at the secondary level.
The board had filed a court injunction late last month to prevent the delays, but a Windsor judge dismissed it due to a technicality and invited the school board to re-apply properly.
The union hand delivered an offer to the board last week but the board rejected it stating there wasn't any meaningful change in the union's position on certain issues, especially lifetime post retirement benefits.
