Two men from last month’s high profile arrest in west-Windsor have both been cleared of homicide charges.
Mohammad Al-Yousufi, 23, and Joshua Gillespie, 28, were both facing first-degree murder charges until the Crown Attorney withdrew those charges earlier this week. That’s according to Windsor defense lawyer Patrick Ducharme, he represents Al-Yousufi.
Ducharme was working on getting Al-Yousufi a bail hearing, but he was able to give him better news.
"Anybody facing a serious charge like that is relieved when the prosecution quickly and efficiently does withdrawals the charge," he says. "These prosecutors, when they realized the evidence wasn't there, they were quick to notify us and we appreciated that."
He tells AM800 News Al-Yousufi has a lot of catching up to do.
"It was distressing for him; he's a university student and was preparing for exams at the time of his arrest. He missed his last couple exams so he didn't finish that and that's frustrating for him," says Ducharme.
Ducharme says his family is ecstatic to have him home.
"Got the family to court so that they could see him have the charge withdrawn and be released to them and they were very happy to have their son back," he added.
Ducharme doesn't represent the other two people involved, but says Gillespie remains in custody for an unrelated offence.
He says 27-year-old Rosalind Nussio is also in custody on a charge of accessory after the fact, but that charge will likely be withdrawn at some point.
