A Windsor man accused of murder is claiming he acted in self defence.
Dia Hanan,36, is charged with second degree murder in the shooting death of 30-year old Alekesji Guzhavin in December 2015 and the attempted murder of Gregory Henriquez.
The trial which began in late October heard that Guzhavin and Henriquez showed up at Hanan's home at 187 Oak St. asking for money.
The defence contends Guzhavin brought the gun, there was a struggle and shots were fired in the dark.
Hanan took the stand in his own defence on Wednesday and testified he returned home around 7pm on December 23, 2015 to find Guzhavin and Henriquez unexpectedly outside of his home.
Hanan testified at one point, Guzhavin pulled out a gun.
Court heard, Hanan asked Guzhavin to leave for 20-30 minutes so that he could try and gather up a couple hundred dollars to give to him.
Hanan told the jurors that he was feeling scared knowing that his wife and two young children were in the house.
When Guzhavin returned to Hanan's home, Hanan gave him $300, but it wasn't enough.
Hanan testified Guzhavin then pointed a gun at his chest.
In fast-paced testimony, Hanan recalled distracting Guzhavin, snatching the gun, there was a struggle and the motion detector light went out.
Hanan said he couldn't see and 'needed to survive', then he heard POW POW POW.
Hanan said when the lights came back on, he saw the two bodies. Hanan then called 9-11.
Guzhavin was shot multiple times and died.
Henriquez was shot and survived the shooting.
During cross examination, Assistant Crown George Spartinos pointed out Guzhavin was shot five times, and Henriquez was shot 2-3 times, yet Hanan wasn't injured.
Spartinos also put to Hanan that since it was a motion detector light, the lights would have been on during the struggle and subsequent shooting.
"It was so dark and I was in a frantic state," said Hanan.
Spartinos put to Hanan that he purposefully shot and killed Guzhavin and then shot Henriquez as he was running away. Hanan disagreed.
Jurors heard earlier in the trial that Guzhavin had been charged with attempted murder stemming from a drive-by shooting in the city a few months before his death.
Hanan was the final witness in the trial.
The defence and prosecution will present their final arguments on Tuesday, November 26th and the judge's charge to the jury will begin on Wednesday, November 27th.
