City councillor Hilary Payne's $2.25-million lawsuit against the City of Windsor has been dismissed.
Superior Court Justice Thomas Heeney disagreed with Payne's contention of malicious prosecution in connection with a 2006 fire.
Payne was a landlord at a home at 614 Mill Street.
One of the tenants was charged with arson but was later acquitted.
Payne and his wife were charged with arson by negligence, but those charges were dropped two years later.
Payne launched the lawsuit in 2010 alleging the investigation was negligent, an abuse of process and an infringement of Payne's Charter rights on the part of the city, police, fire and the Ontario Fire Marshal's office.
No word on whether Payne plans to appeal the court decision.
