The deadline has passed for cancer patients to opt out of a class action lawsuit over diluted chemotherapy drugs.
They had until Wednesday to decide if they would opt out or accept a settlement that would see each patient receive about $1,500 in compensation.
Of the 1,200 patients involved, nearly 300 are in Windsor-Essex.
Windsor lawyer Harvey Strosberg advised against opting out. He tells CTV Windsor that, "based on science, the case will be difficult to win if it goes to court. A reduction in chemotherapy 7-10-percent will not affect result. That's the evidence."
Strosberg says the ordeal may be emotional for some but emotional upset is not compensible in Ontario.
Lawyers involved in the case say they're aware of only a handful who planned to opt out.
