The province's Special Investigations Unit has concluded there are no reasonable grounds to lay charges against Windsor Police following the arrest of a 22-year old man last year.
On the night of September 28th, a plainclothes officer found a man in the parking lot of an apartment building at 333 Glengarry who was wanted on outstanding criminal warrants.
The SIU says the suspect was chased on foot, brought to the ground face first and was arrested.
Police told the man several times to put his hands behind his back, but he failed to comply and was eventually handcuffed after a struggle.
The man was taken to police headquarters then to the hospital where he was diagnosed with mild fractured wrist.
According to the SIU, the suspect alleges he was punched on the chin and head area, four to six times, and his head was smashed on the ground.
The man also told the SIU that he was screaming in pain and asked one of the officers to stop bending his wrist, but the beating continued and the complainant says the officer whispered in his ear saying he was "lucky that this was all he got".
The SIU says no charges will be laid because the suspect never complained about the wrist injury and told medical staff he was unaware of how the injury occurred.
The SIU also found inconsistencies with the suspect's version of events: "Based on all of this evidence, I accept that the complainant did not voluntarily stop running and give himself up to the police, but that he was brought down forcefully by officers and the complainant continued to refuse to give up his hands for handcuffing".
The SIU says the injury was sustained by the man falling on his own hand while fleeing from police and was not excessive use of force.
