Family of the LaSalle teen killed in a crash two years ago has hired a lawyer
The family of a LaSalle teen killed two years ago has filed a lawsuit seeking $3.6-million.
'Beckett Personal Injury Lawyers' have been retained by family members of Emily Bernauer who died in a car crash on September 6th, 2014.
The statement of claim was filed last month against the Shores of Erie International Wine Festival, Sobeys and Renato Rota and Anne Rota.
In a media release issued by the law firm, it reads the "Bernauer family does not desire litigation" but rather the lawsuit will allow for a 'fulsome examination' of the facts.
The family maintains Emily was not texting and driving and that she wasn't impaired by marijuana. Amherstburg police have said texting and driving was a factor and there were chemical compounds of marijuana in her system.
Family lawyer Dallas Lee says the family wants the truth to come out.
"The bigger interest the family has is using the process to compel answers to questions they have had for a couple of years now, our process lets you to compel documents and compels people to testify," says Lee.
"Plainly and obviously she was intoxicated by alcohol when she was driving," says Lee. "We have no doubt about that, the crux of this lawsuit is how she came to consume, the extent and who provided it and who failed to take steps to keep her from driving things like that."
Emily was working at the Sobey's booth at the Shores of Erie Wine Festival before the fatal crash.
She was not of legal drinking age.
A trial is scheduled to start next month on liquor licence charges against the Wine Festival Corporation.
