The company that operates a Windsor Arby's restaurant has filed a lawsuit against the Windsor Police Services Board.
CTV Windsor has learned James Laughton Enterprises has launched a $600,000 suit against the board and two officers in connection to an incident in June where an on-duty officer claimed he was denied service in the name of the Black Lives Matter movement.
The on-duty officer sent a photo of two Arby's employees taking a knee behind the counter to an off-duty colleague who then posted the photo to social media.
The lawsuit names officers Tim Kettlewell, Shawn Farrand and the police board.
The claim is seeking $500,000 for "defamation, libel, slander, negligence, conspiracy, loss of reputation, unlawful interference with business interest, and lost revenue" and aggravated, exemplary and punitive damages in the amount of $100,000.
The lawsuit claims Arby's received "numerous threats from members of the community and were forced to lock-down their two locations for three days to protect the restaurants and their employees from potential harm."
A release issued by Windsor police three days after the incident stated the officers' conduct was under review.
None of the allegations in the claim have been tested in court and no defense has been filed.
