TORONTO — A judicial review is taking place Friday in Toronto as Unifor fights to keep Nemak jobs in Windsor.
The union is appealing a decision to close the west end plant and is challenging an arbitrator's ruling that dismissed a grievance filed against Nemak by Unifor.
The 170 workers, represented by Unifor Local 200, launched the grievance last year arguing the company was violating the terms of the agreement with plans to move work to Mexico.
An arbitrator ruled the union did not establish any violation took place.
The labour dispute resulted in a two week blockade at the plant in September 2019 and fines were levied against the union and four of its members.
The company has not set a date for the closure of the plant.
