Guilty Plea In Windsor Murder Case Called A Hollow Victory

Matthew Brush will be sentenced in the new year for the murder of Cassandra Kaake

A plea of guilty to second degree murder and arson from Matthew Brush is being described as a 'hollow victory' by the father of Cassandra Kaake's unborn child.

Brush will be sentenced in the new year for the brutal murder of Kaake in December of 2014.

She was seven months pregnant at the time.

The father of the child, Jeff Durham, says he's trying to take what positive there is from Brush's admission of guilt. "There's relief to have taken another step, and I suppose, there's relief that we won't have to go through a trial. But from the onset the charges haven't represented the reality that's occured."

Many believe Brush should have faced a second murder charge involving the unborn child. 

That is not included in the Canadian Criminal Code.

Durham continues to gather signatures to revive the "Molly Matters" law which calls for a separate charge in the death of an unborn child.

A five to seven day sentencing hearing is slated to start January 23rd.
