He was released pending his appeal

After serving a week behind bars on a charge of sexual assault, former Windsor Spitfire Ben Johnson has been released from custody.

Defence lawyer Pat Ducharme tells AM800 news he was notified this morning that Johnson was released pending the appeal of his conviction.

Ducharme represented Johnson during his trial but he is not the lawyer who has launched the appeal.

Johnson was found guilty back in September of sexually assaulting a 16-year old girl in the washroom at the former Mynt nightclub in March 2013.

He was sentenced to three years in prison but with the appeal launched, he was granted bail on Tuesday
