An Essex father found guilty of dangerous driving causing death that resulted in the death of his son has lost his appeal.
David McLennan was found guilty by a jury in April 2013 and was handed a nine-month jail term, along wtih two years probation and a one-year driving ban.
McLennan appealed both the conviction and sentence arguing the evidence did not support the verdict and the sentence was "demonstrably unfit."
Both appeals were dismissed by the Court of Appeal for Ontario on Thursday.
In July 2008, McLennan was driving his 1970 restored Mustang on Creek Road in Amherstburg when he hit the shoulder of the road and lost control landing in a field.
His 16-year old son Dylyn who was seated in the rear seat of the vehicle died.
McLennan argued the accident was the result of "momentary inattention and nothing more."
The crown during the trial argued speed was involved, McLennan had been drinking before the crash and erratic driving preceded the accident.
