A Windsor man in his late 20s is a free man after being in custody since April 2017
A drug trafficking case against a Windsor man has been thrown out.
Brandon James Nunn was arrested and charged with drug possession for the purpose of trafficking in April 2017 in downtown Windsor.
He has been in custody since that time but on Friday was released after Justice George King said Nunn's Charter of Rights were violated by a Windsor police officer.
Nunn's lawyer Julie Santarossa says the judge was correct with his analysis of the case.
"In the end he did find that the violations were so incredibly serious that it just couldn't be excluded despite this being a very serious matter," says Santarossa. "There were 81 pills of fentanyl. The judge found that had to be excluded because the police violated Mr. Nunn's rights in so many different ways."
At the time of his arrest, police were responding to a pepper spray incident near the McDonald's at Goyeau and Wyandotte.
Nunn was the victim.
Justice King told the courtroom, the officer searched Nunn before he seeked medical attention.
81 tablets of fentanyl were discovered but the search was deemed illegal.
Santarossa says Nunn is in his late 20's.
She says her client is very happy with the result and is happy to see his family.
