A Windsor man will learn his fate at the end of March following a stabbing in downtown Windsor.
A sentencing hearing is scheduled for March 29 for 22-year-old Benjamin Carter.
Around 9:30pm on June 6, 2018, a young woman was hugged and then stabbed by Carter on Ouellette Ave. near Riverside Dr..
The victim was five months pregnant at the time and the court heard that she suffered a puncture wound to the neck, considered life-threatening to her and the unborn child.
Carter was initially charged with attempted murder, but on November 2, 2018 he pleaded guilty to a charge of aggravated assault.
His attorney, Ken Marley says his client has been in custody for 258 days and argued that he should serve an additional 12 to 18 months.
Marley says that would allow Carter to receive help for mental health issues.
But Assistant Crown Jamie Lesperance says the nature of the crime requires a sentence of four to five years in prison to send the proper message of deterrence and denunciation.
Carter spoke to the court saying he's learned "life is not a game and you can't play around."
Referring to his victim he said "she got hurt for real," and he apologized deeply.
Justice Lloyd Dean allowed Carter to hug his mother and two family friends before being returned to custody.
