A Windsor man charged in a fatal hit and run that killed a three-year-old boy is out of custody on $5,000 bail.
56-year-old Kenneth Dawson is charged with failing to remain at the scene of an accident causing death and criminal negligence causing death in the crash that killed Kevin Eh say.
The boy was struck by a van Monday night at Wyandotte Street and Bruce Avenue and the driver didn't stop.
Eh Say was rushed to the hospital and died of his injuries.
It prompted police to search for a dark green van and Dawson was arrested Tuesday.

As part of his bail conditions, Dawson must live with his sister in the county, he can't drive, he can't consume alcohol and he can't associate with anyone involved in the case.
If he breaches the conditions, his sister must pay the $5,000 bail.
Dawson appeared in court via video dressed in a dark t-shirt and black shorts.
After signing some papers, he quickly walked out of the courthouse and into a waiting pick-up truck.
He returns to court August 8th,
