An appeal hearing is scheduled to begin Tuesday for a former Windsor Spitfire found guilty of sexually assaulting a 16-year-old girl.
Ben Johnson, 23, will have his day in court today in Toronto according to the Court of Appeal for Ontario.
In September 2016, Johnson was found guilty of having sex with a girl in the washroom of the former Mynt nightclub in March 2013.
In handing down the verdict, Judge Kirk Munroe said the victim was so drunk, close to unconsciousness, that she did not have the ability to consent to sex.
Johnson said he never had sexual intercourse with the girl. He testified the girl gave him oral sex, it was consensual and the girl initiated it.
Johnson was sentenced to three years in jail.
