A deputy mayor candidate in Amherstburg has asked for a recount.
Diane Pouget lost to Leo Meloche by four votes in Monday's municipal election.
Pouget went to town hall on Tuesday and asked for a recount but her request was denied.
Town Clerk Paula Parker says the municipality did not pass a bylaw or policy before May 1st indicating how the town deals with a recount.
She says as per the municipal elections act, a recount is automatically done only if there is a tie vote.
"We actually now have to go with legislation and legislation indicates that a recount should be requested by the Superior Court," says Parker.
Parker adds Pouget has 30 days from the official results to appeal to the Superior Court.
"She has to appeal to the Superior Court and she has to give reasonable grounds for the recount," says Parker.
Pouget says she has been in contact with a lawyer.
She received 2575 votes while Meloche got 2579.
The town made the election results official on Tuesday.
